Legal
These Terms of Sale govern the sale of digital products between VAROUM, the seller (sole proprietor, contact@varoum.com), and any consumer or professional buyer on varoum.com.
Any order implies full acceptance of these Terms of Sale.
The products are digital goods: plugins and presets for DaVinci Resolve. Each product is described on its dedicated page (compatibility, features, format).
VAROUM aims to ensure description accuracy. In case of obvious error, VAROUM's liability cannot be engaged.
Prices are in euros (EUR), including taxes where applicable. VAROUM, as a sole proprietor, may qualify for the French VAT base franchise (article 293 B), in which case "VAT not applicable" applies.
The applicable price is the one displayed at order validation. VAROUM reserves the right to change prices at any time.
Purchases are made via PayPal on the product page. After payment validation, a download link is generated and displayed on the site, and sent by email if an address is provided.
The download link is valid for 30 minutes. In case of trouble, a backup email with a fresh link is sent automatically to the PayPal address.
Under French Consumer Code article L221-28, the right of withdrawal does not apply to digital content delivered on a non-tangible medium where performance has started with the consumer's prior express consent.
By completing the purchase and downloading the product, the buyer expressly waives the right of withdrawal.
Products are covered by legal warranties applicable to digital goods (EU directive 2019/770): warranty of conformity and hidden defects warranty.
For non-conforming or defective products, contact contact@varoum.com within 14 days of purchase. A correction, replacement or refund will be offered.
Buying a VAROUM product grants a personal, non-exclusive, non-assignable and non-transferable license of use.
Commercial use is allowed: the buyer may use the product in their own client projects and commercial productions at no extra cost.
Forbidden: reselling the product, redistributing it publicly, embedding it in another product for sale, or sharing it with third parties.
VAROUM cannot be held liable for indirect damages from use or inability to use a product (incompatibility with an unspecified DaVinci Resolve version, data loss, business interruption).
VAROUM's liability is capped at the amount paid by the buyer for the product in question.
In case of dispute, contact VAROUM first by email at contact@varoum.com. A reply is provided within 15 business days.
Failing amicable resolution, consumers may use a free consumer mediator (French Consumer Code article L616-1).
These Terms of Sale are governed by French law. French courts have sole jurisdiction.
